General Terms and Conditions

These General Conditions of Sale (hereinafter the “GCS”) govern the contractual relations between:

Marmaille , SASU, whose registered office is located at 13 rue Marcel Bontemps, 92100 Boulogne-Billancourt, registered in the Trade and Companies Register under number 932 275 100 (hereinafter referred to as “the Seller "),

And

Any natural or legal person (hereinafter “the Customer”) making a purchase via the website www.maison-marmaille.com (hereinafter “the Site”).

Article 1 – Purpose

The purpose of these General Terms and Conditions is to define the rights and obligations of the parties in the context of the online sale of handmade products for children, made to order, offered by Marmaille on its website.

Article 2 – Products

2.1 Description

The products offered for sale are handmade children's items. Each product is made to order, by hand, using an artisanal approach.

2.2 Uniqueness

Due to the artisanal nature of the manufacturing process, slight differences may exist between the product received and the one presented on the Site. These variations cannot be considered as defects.

2.3 Availability

Products are offered for sale subject to availability. In the event of unavailability, the Seller will inform the Customer by email and offer a refund or replacement.

Article 3 – Order

3.1 Order process

The Customer places an order via the Site. To validate the order, the Customer must:

  • Select the desired products,
  • Provide the personal information necessary for delivery,
  • Accept these T&Cs without reservation,
  • Pay the total amount of the order.

3.2 Order Confirmation

The order is considered final upon receipt of full payment. A confirmation email is sent to the Customer. Marmaille reserves the right to refuse an order in the event of a prior dispute or obvious anomaly.

Article 4 – Price

4.1 Pricing

Prices are expressed in euros (€), all taxes included (TTC). Delivery costs are indicated separately before confirming the order.

4.2 Modification

Marmaille reserves the right to change its prices at any time, without notice. Products are invoiced based on the prices in effect at the time of the order.

Article 5 – Payment

Payment is made securely online via:

  • Bank card (Visa, MasterCard, etc.),
  • PayPal.

The order will only be processed upon receipt of payment. No banking data is stored by Marmaille.

Article 6 – Delivery

6.1 Delivery areas

Deliveries are made to mainland France and the European Union.

6.2 Deadlines

As products are made to order, delivery times vary depending on the workload and the number of orders in progress. An estimate of delivery times is displayed on the information banner at the top of the Site.

6.3 Transport

Products are shipped via third-party carriers (La Poste, Mondial Relay, etc.). The Seller cannot be held responsible for delays attributable to the carrier.

Article 7 – Right of withdrawal

7.1 Legal deadline

In accordance with article L221-18 of the Consumer Code, the Customer has a period of 14 days from receipt of the order to exercise his right of withdrawal, except for products made according to the Customer's specifications or clearly personalized , which are excluded from this right (article L221-28).

7.2 Terms and Conditions

To exercise this right, the Customer must notify their decision in writing to the following address: hello@maison-marmaille.com. Returned products must be in perfect condition, unused, and in their original packaging.

7.3 Reimbursement

In the event of a valid withdrawal, Marmaille will reimburse the Customer within 14 days of receiving the return. Return costs remain the responsibility of the Customer.

Article 8 – Warranty and liability

8.1 Legal guarantee

The products sold benefit from the legal guarantee of conformity (articles L217-4 et seq. of the Consumer Code) and the guarantee against hidden defects (articles 1641 et seq. of the Civil Code).

8.2 Limited liability

Marmaille's liability is strictly limited to the amount of the order. The Seller cannot be held liable for indirect damages or any loss related to the use of the products.

Article 10 – Personal data

Personal data collected during the order process is processed in accordance with current regulations (GDPR). The Customer has the right to access, rectify, and delete their data.

Article 11 – Intellectual property

All elements present on the Site (texts, images, graphics, logos, etc.) are the exclusive property of Marmaille. Any reproduction or use without authorization is prohibited.

Article 12 – Applicable law and disputes

These General Terms and Conditions are subject to French law. In the event of a dispute, the parties will endeavor to find an amicable solution. Failing this, the dispute will be brought before the competent courts within the jurisdiction of Marmaille's registered office.
